How and Why Do We Use Personal Information?

With Whom Do We Share Personal Information?

As we mentioned previously we do not sell your personal information, but we may share your personal information with the following categories of people:

  • Our Service Providers: We may share your personal information with our service providers for the purposes we outline above. For example to tell you the nearest farmacy from your location, the minimum necessary health information to generate a prescription.
  • Government Agencies, Regulators and Professional Advisors: Where required by applicable law, we may also need to transfer your personal information to government agencies and regulators (e.g., tax authorities, courts, and government authorities).
  • Organizations Involved in Business Transfers: If we sell, merge or reorganize our company, we expect that the personal information that we have collected will be transferred to the surviving or acquiring entity in accordance with applicable law.

Information of Minors

The Service is not intended to be accessed by minors under the age of eighteen (18) except as authorized by their parents or legal guardian, and we do not knowingly collect any personal information directly from such minors and children without such authorization. If we discover that an individual under 18 has provided us with personal information, we will delete the personal information to the extent required by the Children’s Online Privacy Protection Act.

Your Privacy Rights

You may have legal rights to access, update, or erase certain personal information that we have about you, or restrict or object to how we use it. If you have such rights and you make a legitimate request, we will do what you request. To exercise these rights, please contact us using the details in the “Contact Us” section below. For your security, we may need to request specific information from you to help us make sure the request is coming from you and not someone who has no right to receive it.

How Do We Protect Personal Information?

We implement technological, physical and administrative savegards to protect your personal information from loss, misuse, unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the personal information. We encrypt information in transit and at rest.

Although our endeavor is to keep information secure, we cannot guarantee that our security measures will prevent every unauthorized attempt to access, use or disclose personal information. We maintain procedures to deal with any suspected breach of personal information, and we will notify you and any applicable regulator of a breach where we are legally required to do so.

If you are a resident of California:

California law requires us to provide you with some additional information regarding how we collect, use, and share your “personal information” (as defined in the California Consumer Privacy Act (“CCPA”)).

Categories of personal information we collect. Throughout this Privacy policy, we discuss in detail the specific pieces of personal information we collect from and about users.  Under the CCPA, we are also required to provide you with the “categories” of personal information we collect.  The categories we collect and share for business purposes are:

Sale of Personal Information. The California Consumer Privacy Act (CCPA) sets forth certain obligations for businesses that “sell” personal information. Based on the definition of “sell” under the CCPA and under current regulatory guidance, we do not sell your information. We do share certain information as set forth in With Whom Do We Share Personal Information. and allow third parties to collect certain information about your activity, for example through cookies, as explained in Cookies and Other Technologies. If you are a California resident, you may have certain rights. California law may permit you to request that we:

Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information.

Provide access to and/or a copy of certain information we hold about you.

Delete certain information we have about you.

Opt you out from the sale of information we have about you. As noted above,MiSalud does not sell personal information.

You may have the right to receive information about the financial incentives that we offer to you (if any). You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Service to you and for compliance with applicable law. If you ask us to delete certain information, you may no longer be able to access or use the Service.

California customers may request, once per year, that we disclose the identity of any third parties with whom we have shared personal information for the third parties’ direct marketing purposes within the previous calendar year, along with the type of personal information disclosed.

If you would like to exercise any of these rights, please contact us using the information provided below. You will be required to verify your identity before we fulfill your request. To do so, you will need to provide first name, last name, company and work email address. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You will still need to verify your identity directly with us.
